(As Applicable at Fuel Dispensers)
4.2.6 and 4.27
TDLR has temporarily suspended enforcement of TAS requirements applicable to fuel dispensers installed at subject facilities where construction began prior to October 1, 1998.
The particulars of the temporary suspension are as follows:
TDLR suspends enforcement of TAS 4.2.6 (Space Allowance and Reach Ranges) and TAS 4.27 (Controls and Operating Mechanisms) as applied to payment options on fuel dispensers, where construction begins prior to October 1, 1998.
Facilities where construction begins after October 1, 1998, a minimum of 20% of the fuel dispensers, but not less than one per grade of fuel, will be required to comply with TAS 4.2.6 and TAS 4.27. The 20% requirement applies to all facilities and is to accommodate an interim solution in the form of an auxiliary apparatus or other modification while developmental of an accessible fuel dispenser is pending, regardless of the method of installation.
Until such a time dispensers are manufactured which fully comply with TAS 4.2.6 and TAS 4.27, at least 20% but not less than one fuel dispenser installed at newly constructed or modified facilities on or after October 1, 1998 will be required to comply with TAS 4.2.6 and TAS 4.27.
Fuel dispensers, which are installed at facilities constructed after January 1, 1992 and prior to October 1,1998, shall include a sign at each dispenser suggesting alternative methods for obtaining fuel and/or assistance. Signs directing persons to compliant dispensers shall be prominently displayed.
While conducting plan reviews and/or inspections it will be expected that reference to the suspension will be appropriately noted on the plan review/inspection report. However, if compliant designs/dispensers are proposed/provided, it should also be reflected on the plan review/inspection report.
This position shall be applied to any situation where a plan review and/or inspection has been accomplished based on the dates referenced in the particulars noted above.
